Terms & Conditions

Last updated: April 2026  ·  The Food Phoenix (thefoodphoenix.com)  ·  Operated by Dr Catriona Walsh

Plain English summary: These terms govern your use of this website and any coaching services you purchase. In short: we'll always do our best for you; coaching is not medical treatment; results vary between individuals; and you take responsibility for implementing what we discuss together.

1. Who We Are

This website is operated by Dr Catriona Walsh, trading as The Food Phoenix, a nutrition and lifestyle coaching service.

2. Use of This Website

You may use this website for your own personal, non-commercial purposes. You agree not to:

  • Use this site in any way that breaches applicable laws or regulations
  • Copy, reproduce, or distribute content from this site without written permission
  • Attempt to gain unauthorised access to any part of the website or its systems
  • Use any automated tools to scrape or extract content from this site
  • Post or transmit any harmful, offensive, or misleading material

We reserve the right to restrict or terminate your access to the website if you breach these terms.

3. Intellectual Property

All content on this website — including text, images, graphics, logos, videos, programme materials, and the brand name "The Food Phoenix" — is the intellectual property of Dr Catriona Walsh unless otherwise stated. All rights are reserved.

You may share links to our content and quote brief passages for personal or educational purposes, provided you clearly attribute the source. Any other use requires written permission.

4. Coaching Services

4a. Nature of the Service

The Food Phoenix offers nutrition and lifestyle coaching — not medical treatment, medical advice, or clinical care of any kind. Dr Catriona Walsh holds a medical qualification but operates exclusively in a coaching capacity through this service and does not practise as a physician, diagnose conditions, prescribe medication, or provide clinical consultations.

Coaching is a collaborative partnership. You remain in full control of all decisions relating to your health, diet, lifestyle, and medical care. Nothing we discuss together should replace the advice of a qualified medical professional who knows your full medical history.

4b. Suitability

Our services are intended for adults aged 18 and over. By engaging our services, you confirm that you are 18 or older and have legal capacity to enter into this agreement.

Certain health conditions may make our programme unsuitable for you, or may require you to work alongside your medical team. We reserve the right to decline to work with you, or to discontinue working with you, if we have concerns about your safety or suitability for the programme.

4c. Your Responsibilities

As a client, you agree to:

  • Provide accurate and complete information about your health history and circumstances
  • Inform us promptly of any changes to your health status or medication
  • Continue under the care of your GP and any relevant specialists for medical matters
  • Take responsibility for implementing any recommendations — we provide guidance, you make the choices
  • Treat our sessions and materials with respect and confidentiality
  • Not record sessions without prior written consent

4d. Payments and Bookings

Payment terms, programme fees, and booking arrangements are set out at the point of purchase. All fees are stated in GBP (£) unless otherwise specified and are inclusive of any applicable VAT where relevant.

Payment constitutes your acceptance of these Terms & Conditions and any programme-specific terms provided at the time of purchase.

4e. Cancellation and Refunds

Cancellation of sessions: Please give at least 48 hours' notice to cancel or reschedule a session. Sessions cancelled with less than 48 hours' notice may be forfeited at our discretion.

Programme refunds: Where you are a consumer resident in the UK or EU, you have a statutory 14-day right to cancel a distance contract (the "cooling-off period"), beginning from the date of purchase. If you request and we provide services within that 14-day period, a proportionate deduction will be made for services already delivered.

After the cooling-off period, refunds are at our discretion. We do not offer refunds on the basis of results, as outcomes depend substantially on the effort and commitment you bring to the process.

Nothing in these terms affects your statutory rights as a consumer under UK law.

4f. Programme Content and Delivery

We reserve the right to update, modify, or improve programme content at any time to reflect new research or best practice. Core programme structure and your access to materials will not be materially reduced once you have enrolled and paid.

5. Disclaimer of Warranties

This website and its content are provided on an "as is" basis. We make no warranties — express or implied — about the accuracy, completeness, or suitability of the information for your particular circumstances.

Health and nutrition are complex, highly individual fields. What works for one person may not work for another. We cannot and do not guarantee any specific health outcomes from working with us.

We make reasonable efforts to keep the website available and accurate, but we cannot guarantee uninterrupted access or that the site is free from errors or viruses.

  • Any indirect, incidental, or consequential loss or damage arising from your use of this website or our services
  • Any health outcomes resulting from implementing (or failing to implement) coaching recommendations
  • Loss of income, business, or opportunity
  • Any inaccuracy in third-party information linked to from this site

Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot legally be excluded under UK law.

Our total liability to you for any claim arising out of or in connection with your purchase of services shall not exceed the amount you paid for those services.

7. Confidentiality

We treat all information you share with us in a coaching context with strict confidentiality. We will not disclose your personal information to third parties except:

  • Where you have given explicit consent
  • Where we are required to do so by law
  • Where there is a serious and immediate risk of harm to you or others

We ask that you treat our programme materials, intellectual property, and any information shared by other clients (in group settings, if applicable) with equivalent confidentiality.

8. Testimonials and Results

Testimonials and case studies shared on this website represent the experiences of individual clients and are not guarantees of your results. Your outcomes will depend on your unique health history, circumstances, level of commitment, and factors outside our control.

We present testimonials in good faith and have not modified them in any way that would make them misleading.
